Terms of Use

Last updated: 2026-05-10

1. Acceptance of Terms

By accessing or using Libermall DEX at dex.libermall.com (the "Platform", the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Platform. The Service is operated by Libermall LLC, a Wyoming-registered limited liability company.

2. Non-Custodial Nature

Libermall DEX is a non-custodial interface to public smart contracts deployed on the TON blockchain. We never hold, control, or have access to your funds, private keys, mnemonics, or digital assets. All transactions are signed locally in your wallet and broadcast directly to the blockchain. You are solely responsible for the security of your wallet and the consequences of every transaction you authorize.

3. Eligibility & Geographic Restrictions

You must be at least 18 years old and have the legal capacity to enter into a binding contract.

Restricted jurisdictions. The Service is not offered to, and you may not use it if you are: a US Person, located in the United States, or located in any jurisdiction subject to comprehensive US sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, Luhansk, Kherson, and Zaporizhzhia regions of Ukraine), or otherwise on any official sanctions list (OFAC SDN, UN, EU, UK).

It is your responsibility to ensure your use of the Platform complies with all laws applicable to you. We may, at our sole discretion, employ technical measures (IP geofencing, wallet-level blocks) to enforce these restrictions.

4. Risk Disclosure

Use of decentralized exchanges involves significant risks, including but not limited to:

  • Smart contract risk. Bugs or vulnerabilities in any contract can result in irreversible loss.
  • Market risk. Crypto prices are highly volatile. Asset value can drop to zero.
  • Liquidity risk. Thin pools may cause failed trades, high slippage, or sandwiching.
  • Impermanent loss. Providing liquidity may result in withdrawal worth less than holding the underlying tokens.
  • Aggregator / third-party risk. When you choose the Aggregator route, execution depends on the Omniston / STON.fi protocol — we do not control and are not responsible for their outcomes.
  • Scam-token risk. Listing of a token in our interface is not an endorsement. Tokens listed via STON.fi or community submissions may be fraudulent, malicious, or have hidden mint authority. Conduct your own due diligence.
  • User error. Sending funds to a wrong address, signing a malicious transaction, or losing your seed phrase is irreversible. We cannot help recover lost funds.
  • Service availability. The frontend may experience downtime, network attacks, or temporary unavailability. The underlying smart contracts remain accessible directly on-chain even when our frontend is offline.
  • Regulatory risk. The legal status of cryptocurrencies and DEX interfaces varies by jurisdiction and may change without notice.

5. No Financial or Legal Advice

Nothing on the Platform constitutes financial, investment, legal, tax, or accounting advice. APY rates, price quotes, and analytics are estimates derived from on-chain data and third-party feeds; past performance does not guarantee future results. Always consult qualified professionals before making financial decisions and conduct your own research.

6. Token Listings

Tokens displayed in our interface include those with native Libermall liquidity pools and those routed via the STON.fi/Omniston aggregator. Listing or display of any token is not an endorsement and does not represent any review of the token's code, team, or compliance. We may add, hide, or de-list any token at our sole discretion to comply with law or to protect users.

7. Prohibited Uses

You agree not to use the Platform to:

  • Violate any applicable law, regulation, or sanctions program
  • Launder money, finance terrorism, or evade taxes
  • Engage in market manipulation, wash trading, or front-running
  • Distribute malware, phishing pages, or fraudulent tokens
  • Probe, scan, or attempt to exploit the Platform, its smart contracts, or its infrastructure beyond what is permitted by an authorized bug-bounty program
  • Reverse-engineer, scrape, or copy the proprietary frontend interface for competing services

8. Intellectual Property

The Libermall DEX interface, branding, copy, and design are owned by Libermall LLC and protected by applicable intellectual-property laws. Smart-contract source code released under an open-source license is governed by that license. You receive a limited, non-exclusive, non-transferable, revocable license to use the Platform per these Terms.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LIBERMALL LLC MAKES NO WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECT WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIBERMALL LLC AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF FUNDS, PROFITS, GOODWILL, OR DATA — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, REGARDLESS OF THE LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED ONE HUNDRED US DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless Libermall LLC, its affiliates, officers, and employees from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your misuse of the Platform.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Platform shall be resolved by binding arbitration in Wyoming under the rules of the American Arbitration Association, except either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be posted with an updated "Last updated" date and may be announced through our official channels. Continued use of the Platform after a change becomes effective constitutes your acceptance.

14. Severability & Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Libermall LLC regarding the Platform and supersede any prior agreements.
